JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-07-2020 Heard Mr. Bimlesh Kumar Pandey, learned Advocate for the petitioner and Mr. Anand Mohan Pd. Mehta, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Dhanaha P.S. Case No. 54 of 2019 dated 01.04.2019 instituted for the offences under Sections 467, 420, 409, 467, 468 and 34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that as the allegation stands, despite the Government disbursing an amount of Rs. 3,92,000/- for installation of solar lights which was to be supplied by the petitioner, the same has not been done.

The learned counsel for the petitioner submits that because no direction was given to the petitioner, the same was not supplied by him. The entire money meant for the aforesaid purpose has been deposited in the State treasury. Taking into account the aforesaid facts, one of the accused persons viz. Jata Shankar Thakur has been granted bail vide order dated 21.10.2019 in Cr. Misc. No. 50258 of 2019. Regard being had to the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of six weeks, on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with Dhanaha P.S. Case No. 54 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
