Mr. SRI ANISH CHANDRA ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Mirganj P.S. Case No. 311 of 2014 registered for the offences punishable under Sections 420, 417, 406, 467 and 468 of the Indian Penal Code.
Allegation against the petitioner, as made by informant, is that even after accepting Rs. 3, 35,000/- as consideration money for executing sale deed, possession of land could not be given by petitioner from his share in the property. Thereafter, petitioner promised to return the consideration amount Rs. 3, 35,000/- to the informant to satisfy legal debt and issued cheque in favour of informant which was dishonored by Bank. It has been further stated that thereafter petitioner promised to execute sale deed of five kattha land and for which informant will have
Patna High Court Cr.Misc. No.52316 of 2017(2) dt.09-11-2017 2/2 to pay Rs. 5,70,000/- more. Allegation against petitioner is that even after such payment, sale deed was not executed in favour of informant. However, learned counsel for the petitioner submits that he has already paid Rs. 2,60,000/- to informant and now he is ready to pay the rest of the amount. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj, in connection with Mirganj P. S. Case no. 311 of 2014.
