JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-11-2017 The petitioner seeks regular bail in connection with Jhajha P.S. Case No. 179 of 2017, registered for offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act. Allegation against the petitioner that at his instance one rifle and six cartridges were recovered from the jungle. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and only allegation against the petitioner that at his instance rifle and cartridges were recovered, for which he has sufficiently been punished as he has been in custody 09.07.2017 and though he is an accused in two more cases but in one case he has been acquitted and in the other case is fixed for judgment.

No.52735 of 2017 (3) dt.23-11-2017 Having heard both sides, considering the fact and circumstances of the case and nature of allegation, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to release the petitioner to his own satisfaction once charge is framed in this case with condition that he will cooperate in disposal of trial and shall appear on each and every date except on showing genuine reasons.
