2. The petitioner seeks bail in connection with Khagariya P.S. Case No. 834 of 2019 registered for the offence under Sections 341, 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and others are accused of killing the deceased.

4. The petitioner is in custody since 5.5.2022 in connection with the present case.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case. He further submits that though the allegation against the petitioner is of killing the deceased but the assailant of deceased is one Madan Yadav. He also submits that till date, the case has only been committed in the Court of

Patna High Court CR. MISC. No.18376 of 2026(5) dt.23-07-2026 2/2 Sessions and the trial of the petitioner is delayed.

6. Considering the period of custody of the petitioner and the delay in trial, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned concerned Court below in connection with Khagariya P.S. Case No. 834 of 2019.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Dandari Police Station on every Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.

9. After being released on bail, the petitioner is directed to cooperate in the trial by appearing personally till the framing of charge, if the charge has not already been framed and after framing of charge he is directed to cooperate in the trial either by appearing personally or through his lawyer. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
