The petitioners are apprehending their arrest in a case instituted under Sections 365 and 504/34 of the Indian Penal Code. It is alleged by the informant that the informant's brother was sitting on a Machan, the petitioners called him and took to another side of the river and assaulted there and taken towards village-Bishariva. The reason behind the occurrence that three days prior to the this occurrence, all the accused persons had abused to his brother.

It has been submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.28421 of 2015 (3) dt.01-10-2015 the petitioners have got no criminal antecedent. As per the allegation, it is said that the victim was abducted by the petitioners. From perusal of Annexure-2, it appears that on the alleged date of occurrence the victim was apprehended for an offence under the Arms Act and taken into custody by the police and thereafter, the chargesheet was submitted against the said victim which is also set part of Annexure-2. The informant only to save their skin got the prosecution case instituted against the petitioners making an allegation of abduction. On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with K.Nagar (Maranga) P.S.Case No.177 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
