JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-04-2018 Learned counsel for the petitioner submits that he has statutory remedy by way of appeal to the State Appellate Authority and, as such, he may be granted liberty to approach the State Appellate Authority, which has now comes into force. Considering the aforesaid, the writ application is disposed off with liberty to the petitioner to file appeal before the State Appellate Authority.

In case such appeal is filed by the petitioner within a period of one month from today along with a copy of this order, the State Appellate Authority is required to decide the appeal on

Patna High Court CWJC No.9950 of 2016(2) dt.18-04-2018 2/2 its own merit after condoning the delay, if any, in filing the appeal in view of the fact that the order of the District Teachers Employment Appellate Authority, dated 02.05.2016, challenged by the petitioner in the present writ application on 23.06.2016 and the same remained pending for nearly two and half years. With the aforesaid directions, the present writ application stands disposed off.
