The petitioner seeks bail in Samastipur (Muffasil) P.S. Case No. 126 of 2018 registered for the offence punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code. Allegation against the petitioner is of committing murder of the son of the informant in collusion with other coaccused persons named in the FIR. It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely implicated in this case. Learned counsel for the petitioner submits that nothing incriminating material has been collected during investigation against the petitioner to implicate him in
Patna High Court Cr.Misc. No.45662 of 2018(2) dt.27-07-2018 2/2 this case. Petitioner has got no criminal antecedent and is in custody since 19.03.2018. It has been further submitted that similarly situated co-accused persons namely Shankar Thakur, Jogindra Thakur and Ram Babu Das who have also been named in the FIR have been granted bail by a co-ordinate bench of this Court vide order dated 29.06.2018 passed in Criminal Miscellaneous No. 33123 of 2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-5, Samastipur, in connection with Samastipur (Muffasil) P.S. Case No. 126 of 2018.
