Another lady Teacher of the School, by name Varsha, submitted a complaint on 25.4.2014 in the police Station Kharagpur alleging that the petitioner had tried to outrage her modesty on 25.4.2014, for which offence punishable under section 354 and 506 I.P.C. was registered.

Apprehending arrest, the petitioner filed A.B.P. No.378 of 2014 in the court of the Sessions Judge, Munger. The same was dismissed on 2.8.2014. Hence, this application for grant of anticipatory bail under Section 438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

The allegation against the petitioner is not serious.

No.37481 of 2014 (2) dt.26-03-2015 2/2 It is submitted that the petitioner is the In-Charge Headmaster of the School and when he took objection for the late coming of the complainant, she filed the complaint. The matter needs to be examined in the trial. The application is allowed.

In the event of arrest, the petitioner is directed to be released on bail on furnishing the bail-bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Munger, in connection with Kharagpur P.S. Case No.103 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further subject to the condition that he shall appear before the police station concerned in the first week of April, 2015 and co-operate with the police in the investigation.
