JUSTICE RAVI RANJAN ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and the State. Petitioners apprehend their arrest in a case registered for the offences punishable under sections 147, 148, 149, 341, 323, 324, 325, 308, 379, 504 and 354 447 and 504 of the Indian Penal Code. It is submitted that the alleged altercation took place due to the land dispute as the allegation is that the accused persons were trying to harvest the potato crop. It is further submitted that all the injuries are simple in nature except one which is grievous injury but that is also not on any vital part or organ of the body. It is also stated that the petitioners do not have any criminal antecedents.
Having regard to the facts and circumstances of the case, let
Patna High Court Cr.Misc. No.36785 of 2014 (2) dt.20-02-2015 the abovenamed petitioners, namely, Sudhir Thakur, Santosh Thakur and Umleshwari Thakur, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Saur Bazar Police Station Case No. 21/2014 on furnishing bail bonds of Rs.10,000/- ( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
