====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 10-07-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners seek bail in connection with Pasraha P.S. Case No. 182 of 2023 dated 08.07.2023, G.R. No. 2247 of 2023 registered for the offences punishable under Sections 302, 342, 323, 120B read with Section 34 of the I.P.C.
3. As per the prosecution case, the F.I.R. named accused persons including the petitioners came in the field of the informant and prohibited for harvesting in the said field and on protest being made by the mother of the informant then on the order of the other co-accused Mahendra Singh, the co-accused Sattan Singh, Dabloo Singh, Babloo Singh, Rajdeo Singh
Patna High Court CR. MISC. No.18510 of 2025(3) dt.10-07-2025 2/3 (petitioner no. 2) and Fulo Singh assaulted the informant's mother with Knife and Kulhari, due to which, she died. The accused persons also assaulted the other family members of the informant. The reason behind the occurrence is that the aforesaid accused persons earlier killed the father and uncle of the informant for the said land dispute for which Pasraha P.S. Case No. 39 of 2014 was lodged against the aforesaid accused persons in which the mother of the informant was witness.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in the present case. It is further submitted that the petitioner no. 1 was not present at the relevant point of time of the alleged occurrence rather he was present in his house which will be evident from his mobile location. Similarly the wife of the petitioner no. 2 has filed an application before the S.D.P.O., Gogari requesting therein that her husband Rajdev Singh (petitioner no. 2) is not involved in the alleged occurrence rather he was at Chitradurga in Karnataka for his livelihood and he has falsely been implicated in the present case due to dirty village politics. There is no specific allegation of assault on the deceased against the petitioners rather the specific allegation of assault is against the co-accused Sattan Singh, Dabloo Singh,
Patna High Court CR. MISC. No.18510 of 2025(3) dt.10-07-2025 3/3 Babloo Singh and Fulo Singh. There is general and omnibus allegation against the petitioners. It is further submitted that the other co-accused person, Chandeshwari Singh has already been granted bail by the Co-ordinate Bench of this Court in Cr. Misc. No. 30757 of 2024 vide order dated 19.07.2024. The petitioners have two criminal antecedents and in one case, they are on bail as stated in paragraph no. 3 of the bail application. The petitioners are in custody in this case since 07.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the prayer for bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well the period of custody, let the above named petitioners, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Pasraha P.S. Case No. 182 of 2023, G.R. No. 2247 of 2023.
7. The application stands allowed.
