This application is filed for grant of regular bail in connection with Sherghati P.S. Case No. 628 of 2022, registered under section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that there is recovery of 50 litres of country made liquor from a motorcycle. The petitioner is in custody since 01.02.2023 and he has clean antecedent.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.19203 of 2023(2) dt.22-05-2023 2/2 Considering the period of custody and the nature of allegations levelled against the petitioner as well as the fact that he has clean antecedent, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-cum-Exclusive Special Excise Court No.-02, Gaya in connection with Sherghati P.S. Case No. 628 of 2022.
