The petitioner is in custody since 19.04.2018 in connection with Tr. No. 49 of 2018 arising out of Kathaiya P.S. Case No. 46 of 2018 for the offence registered under Section 366, 365 and 366A of the Indian Penal Code and Section 8 and 12 of the POCSO Act.
Learned counsel for the petitioner submits that there is nothing on record to show the complicity of the petitioner as the victim girl in her statement under Section 164 Cr.P.C. has categorically stated that she had herself eloped with one Suraj Kumar and the petitioner has not been named in the said statement.

No.46072 of 2018 (2) dt.18-08-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sepecial Judge, POCSO Act, Muzuffarpur in connection with Tr. No. 49 of 2018 arising out of Kathaiya P.S. Case No. 46 of 2018.
