In compliance of the order dated 25.05.2023, petitioner along with opposite party no.2 personally appears in the court today.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 498(A) of the Indian Penal Code and Section 4 of the D.P. Act pending in the learned court below.

The allegation against the petitioner is of torturing the informant in association of his family members on account of non-fulfillment of demand of dowry and of ousting her out of the matrimonial house.

Patna High Court CR. MISC. No.17798 of 2023(3) dt.04-07-2023 2/2 It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. Petitioner has never made any dowry demand and has been falsely implicated in the present case mostly on suspicion and grudge. Petitioner is ready to take away his wife from her maternal home and also willing to keep his wife with full dignity and honour.

Considering the aforesaid facts and circumstances, let the petitioner, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Complaint Case No.135(C)/2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
