The petitioner seeks bail in connection with Banka P.S. Case No. 467/2017, registered for the offence punishable under Sections 363, 365 and 34 of the Indian Penal Code. The mentally sick brother of the informant is said to have been kidnapped by the petitioner along with other accused persons after getting the sale deed of his land executed in favour of one Bibi Darkhasan wife of Md. Babar.

It is submitted by the learned counsel for the petitioner that petitioner is not concerned with the execution of the aforesaid sale deed. As a matter of fact, after demise of mother of the informant petitioner was vending Sattu at the place of her mother for which the informant has been claiming rent and on refusal to

Patna High Court Cr.Misc. No.53782 of 2017 (2) dt.09-11-2017 2/2 oblige her, she has filed false and frivolous case against the petitioner. He has been languishing in custody since 21.08.2017 and is aged about 70 years old.

Considering the facts and circumstances of the case, the above named petitioner, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 467/2017.
