The petitioner seeks bail in Chapra Town P.S. Case No. 47 of 2018 registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code. Allegation against the petitioner is of habitually dealing in stolen property as well as assisting in concealment of stolen property.
It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. It has been further submitted that name of the petitioner has transpired in this case on the basis of confessional statement of co-accused Binod Rai, who has already been granted bail by a co-ordinate bench of this Court vide order dated 26.04.2018
Patna High Court Cr.Misc. No.46876 of 2018(2) dt.08-08-2018 2/2 passed in Criminal Miscellaneous No. 18374 of 2018. Petitioner has got no criminal antecedent and is in custody since 01.03.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XI, Saran at Chapra, in connection with Chapra Town P.S.
