Petitioner apprehends his arrest in connection with Kankarbagh P.S.Case No. 126/2014 registered for the offences punishable under Sections 414/34 of the Indian Penal Code and under Section 25 (1-B) A/26/35 of the Arms Act. Allegedly, acting on a tip off, the police raided the house of the petitioner and besides stolen articles, country made pistol alongwith magazine was recovered but the petitioner was succeeded in fleewing away.
Submission is of false implication, country made pistol was planted by the police and other recovered articles were purchased by the petitioner and the petitioner has got no criminal
Patna High Court Cr.Misc. No.36617 of 2014 (3) dt.09-04-2015 2/2 antecedent and as such the petitioner deserves sympathetic consideration to which the learned A.P.P. opposes. Considering the recovery of several stolen articles and country made pistol from the house of the petitioner, this Court is not inclined to grant the privilege of pre-arrest bail to the petitioner and as such, his such prayer stands rejected.
