JUSTICE SUDHIR SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Section 302 read with Section 34 of the Indian Penal Code.
Allegation against the petitioners is to have murdered husband of the informant.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. From perusal of the F.I.R. itself it would appear that petitioners have been named in the present case merely on the basis of suspicion. F.I.R. was instituted on 17.3.2015. Subsequently, a petition was filed by the informant on 19.3.2015 in the court below stating that due to mistake of fact petitioners have been named in the present case. The said petition is Annexure-2 to the present petition. Other co-accused has been granted anticipatory bail vide Cr. Misc. no. 29513 of 2015. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

No.28222 of 2015 (4) dt.04-11-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Ghosi (Okari O.P.) P.S. Case no.52 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
