The petitioner is in custody since 25.01.2018 in connection with B.P. No. 907 of 2018 arising out of Ahiyapur P.S. Case No. 82 of 2018 for the offence registered under Sections 25 (1-B)A, 26 of the Arms Act.

Learned counsel for the petitioner submits that though it is alleged that the recovery was made from his possession, the same was not recovered from his conscious possession and he has been languishing in jail for more than six months. The petitioner is also not having any criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court Cr.Misc. No.46753 of 2018 (2) dt.27-08-2018 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ahiyapur P.S. Case No. 82 of 2018 in connection with Chief Judicial Magistrate, Muzaffarpur.
