====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-04-2025 At the outset, learned counsel for the petitioner seeks permission to make correction in paragraph - 8 of the bail petition.
2. Permission is accorded.
3. It may be done in course of the day.
4. Heard learned counsel for the petitioner and Mr. Umeshanand Pandit, learned A.P.P. for the State.
5. The petitioner apprehends his arrest in a case registered for the offence under Sections 118(2), 109(1), 61(2) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
6. Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of firing is against coaccused Vishal Kumar. So far as this petitioner is concerned, there is general and omnibus allegation and no specific
Patna High Court CR. MISC. No.17154 of 2025(2) dt.07-04-2025 2/2 allegation of overt act has been alleged against him. Only fact, which has come against this petitioner, is that he was also chasing the deceased alongwith other co-accused persons. Petitioner claims clean antecedent.
7. Learned A.P.P. for the State has opposed the bail petition.
8. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bhagalpur, in connection with Sultanganj P.S. Case No. 541 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
