JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-01-2018 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dinara P.S. Case No. 217 of 2017 instituted for the offences under Sections 341, 323, 504, 506, 376, 511 and 448 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act, 2016.

The accusation against the petitioner is regarding the petitioner entering the house of the informant and trying to molest the informant and when he was caught, the Police found that smell of liquor was coming from his mouth.

The learned counsel for the petitioner submits that a general and omnibus allegation has been levelled against the petitioner, he is languishing in custody since 26.07.2017 and

Patna High Court Cr.Misc. No.52358 of 2017 (3) dt.03-01-2018 2/2 barring one case, he has a clean antecedent and in the said case he is on bail.

Considering the nature of accusation and the period of custody already undergone, I deem it fit and proper to enlarge the petitioner above named on regular bail on furnishing bail bond of Rs. 50,000/- (rupees fifty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excisecum-Additional Sessions Judge-II, Rohtas at Sasaram in connection with Dinara P.S.
