Learned counsel for the petitioners undertakes to remove the defects within four weeks of normal court proceedings. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
The petitioners apprehend their arrest in Ekma P.S. Case No.237 of 2017, registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code. The petitioners are said to have helped Avinash Chaudhari in kidnapping the daughter of the informant.
Patna High Court CR. MISC. No.28032 of 2021(3) dt.01-02-2022 2/3 Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The specific allegation is against Avinash Chaudhari @ Suraj Chaudhari. Learned counsel for the petitioners further submits that petitioner no.1 is mother and petitioner no.2 is sister of co-accused, Avinash Chaudhari. It is submitted that according to the school certificate, the age of the victim is 16 years but the medical board has assessed the age of the victim girl as 19 years. The petitioners have got no criminal antecedent as stated in para 3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioners and submitted that the statement of the victim girl has been recorded under Section 164 of the Code of Criminal Procedure in which she has supported the prosecution case.
Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Saran in connection with Ekma P.S. Case No.237
