The petitioner apprehends his arrest in a case under Section 409 and other Sections of the Indian Penal Code. The petitioner was posted as Assistant Branch Manager and Branch Manager in Indian Bank, Balua Branch, from 13.12.2004 to 10.05.2010 when he opened fake account and transferred money of different account holders and withdrew money from the fake account. It has come during the course of enquiry that Rs. 34,00,000/- and odd has been withdrawn by the petitioner during his tenure as Assistant Branch Manager and Branch Manager of the bank.

Patna High Court Cr.Misc. No.5418 of 2015 (5) dt.23-06-2015 2 / 2 Learned counsel for the petitioner submits that the petitioner was transferred in the year 2010. The audit of the bank was done in the year 2011-12 but no irregularity and illegality was found.

Considering the fact that the petitioner being the Assistant Branch Manager and Branch Manager of the Indian Bank, Balua Branch, opened fake account and transferred the money from the different account holders and withdrew the money and thereby caused loss of Rs. 34,00,000/- and odd to the bank, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the same is rejected in Krishnagarh(Barhara) P.S. Case No. 302 of 2012, pending in the court of the learned C.J.M., Bhojpur at Arrah.
