JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Nokha P.S. Case No. 70 of 2017, registered under Sections 272, 273 and 120B of the Indian Penal Code and Section 30(a) of the Bihar Excise Act.

The accusation is that in course of patrolling duty one person was seen in suspicion condition on road near Scorpio vehicle, on which, police intercepted and made query then he disclosed his name as Rupesh Kumar. On search, 32 pouches each containing 200 ml country made liquor were recorded. On query, Rupesh Kumar also disclosed the name of eight persons including the petitioner indulging in the business of illicit liquor

Patna High Court CR. MISC. No.15705 of 2020(2) dt.14-05-2020 2/2 and on whose disclosure, a truck was also searched, from which, 13,200 pouches each containing 200 ml country made liquor were recovered.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather his name has surfaced in the confessional statement of co-accused, Rupesh Kumar, who was apprehended at the spot with illicit liquor. It is further submitted that petitioner has no criminal antecedent and is in custody since 16.01.2020.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge Excise, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 70 of 2017. Out of two sureties, one surety must be the close relative of the petitioner.
