JUSTICE PARTHA SARTHY ORAL ORDER 06-01-2023 Heard learned Senior counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has prayed for grant of regular bail in a case registered under sections 307, 353, 379, 420, 411, 504, 506, 427, 333, 186, 323, 341, 147 and 149 of the Indian Penal Code, sections 4 and 40 of Bihar Minor Minerals (Concession and Prevention of Illegal Mining, Transport and Storage) Rules, 1972 and section 15 of Environment Protection Act, 1986. As per the prosecution case, the informant states that on receiving information about illegal transportation of sand, raid was conducted. In the torch light the informant claims to have identified 19 named accused persons including the petitioner herein and about 150 others were also present. He has no concern with the alleged occurrence nor with the illegal mining or transport of the sand. He has no connection with any of the incriminating articles. Further the case of the petitioner who is in custody since 7.2.2022 stands on a similar footing to that of co-accused Munna Razaq who has been enlarged on regular bail and on a better footing to that of co-accused Santosh Kumar and Chintu Kumar who have been enlarged on anticipatory bail. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the grant of bail to the above mentioned three co-accused, the petitioner having remained in custody for 10 months since 7.2.2022 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Barun P.S. Case no. 86 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad.
