The petitioner seeks bail in Birpur P.S. Case No. 246 of 2016 registered for the offence punishable under Sections 147, 148, 149 302 of the Indian Penal Code.

Allegation against the petitioner is that he was a member of the mob by whom the deceased was killed on the allegation that he was a child lifter. Allegation in the F.I.R. is against unknown villagers of killing unidentified victim on suspicion that he is a child lifter. It has been further submitted that the petitioner has got no criminal antecedent and is in custody since 14.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon

Patna High Court Cr.Misc. No.59498 of 2017(3) dt.15-01-2018 2/2 furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Birpur (Supaul) in connection with Birpur P.S. Case No. 246 of 2016.
