JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Explanation of learned Sessions Judge is accepted. Heard the learned counsel for the petitioner. Allegation against the petitioner is that he along with others having armed with Talwar, Farsa and lathi came and started abusing and assaulting Bashistha Singh. One of the injury was found to be grievous in nature.

Submission of learned counsel for the petitioner is that all the other accused have been granted bail and there is allegation of assault by sworn causing injury on head and rib. Submission of learned counsel for the petitioner is that no sharp injury was found on the person injured. He is in custody for six months and all other co-accused have been granted bail.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.61659 of 2017 (5) dt.28-02-2018 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XI, Siwan in connection with Daraunda (M.H. Nagar) P.S. Case No.132 of 2017 on condition that one bailor should be local person having properties in the jurisdiction of the Court and petitioner will cooperate in trial and remain present, as and when required by the Court.
