The petitioner is languishing in custody since 15.12.2018 in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

The prosecution case as per the written report of Anil Kumar submitted to SHO, Phenhar Police Station is to the effect that the pick-up van of the informant was returning from Phenhara after selling goods, in the meantime on the way, three motorcycle riders robbed cash amount of Rs.1,62,000/- from the informant's staff, travelling in the said vehicle, leading to the registration of FIR against unknown persons. It is further alleged that the name of the petitioner sprang up on the confessional statement of co-accused Manish Kumar Singh @Bholi Singh.

No.17283 of 2019(2) dt.27-03-2019 2/2 It is submitted by learned counsel for the petitioner that there is no recovery from the conscious physical possession of the petitioner and investigation has already been concluded. It is further submitted that the petitioner has not been put on T.I. parade till date. A statement has been made in paragraph no. 3 of the petition that the petitioner is involved in two other cases out of which, he is on bail in one case.

Learned APP for the State submits that the name of the petitioner sprang up on the confessional statement of coaccused Manish Kumar Singh @Bholi Singh. Considering the fact that there is no recovery from the conscious physical possession of the petitioner, investigation already being concluded and the petitioner has not been put on T.I. parade till date, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-12, Motihari, East Champaran in connection with Fenhara P.S. Case No.63 of 2016.
