The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
2268 liters of illicit foreign liquor has been recovered from Hayva vehicle, of which, this petitioner is registered owner.
It is submitted that without his knowledge or consent of the petitioner, his vehicle was being used for transportation of illicit liquor and petitioner has been made accused simply because he is owner of the said vehicle. Petitioner has got clean antecedent.
However, learned A.P.P. for the State vehemently
Patna High Court CR. MISC. No.18423 of 2022(2) dt.22-07-2022 2/2 opposed the prayer for anticipatory bail and submitted that recovery has been made from the vehicle, of which, this petitioner is registered owner.
Considering the fact that recovery has been made from the vehicle of the petitioner, the prayer for anticipatory bail of petitioner is rejected.
