ANJANA MISHRA ORAL ORDER 14-12-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 07.04.2017 in connection with Ara (M) P.S. Case No. 57 of 2017 for the offence registered under Sections 392, 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the first information report but only on the basis of the confessional statement of one Rajdeo Kumar @ Nanhki @ Rajdeo Kumar Bind, made before the police, the petitioner is being prosecuted in the present case. The said Rajdeo Kumar @ Nanhki @ Rajdeo Kumar Bind, who had made the confessional statement before the police, which is not admissible

Patna High Court Cr.Misc. No.58905 of 2017 (2) dt.14-12-2017 2/2 in evidence, has since been released on bail in Cr. Misc. No. 42766 of 2017 vide order dated 27.11.2017. It is further submitted that the petitioner has not put on T.I. Parade till date and there is no recovery from the conscious possession of the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Mufassil P.S. Case No. 57 of 2017.
