JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Lodipur (Bypass) P.S. Case No. 95 of 2020, registered for the offence punishable under Sections 366A, 323, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submit that the petitioners are innocent and falsely been implicated in this case. Petitioners have no criminal antecedent. The allegation against the petitioners are general and omnibus in nature. Similarly situated co-accused namely Sukan Kumar has already been granted bail by a co-ordinate Bench of this Court vide order

Patna High Court CR. MISC. No.23428 of 2023(2) dt.22-05-2023 2/2 dated 29.06.2021 passed in Cr. Misc. No. 12344 of 2021. Petitioners are in custody since 14.09.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Lodipur (Bypass) P.S.
