Mr. Sri Anil Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 01-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Darbhanga Sadar P.S.Case No. 80 of 2018 registered under Sections 147, 148, 149, 302, 307, 323, 324, 341 and 120B of the Indian penal Code and 27 of the Arms Act. Allegation in brief is that informant's brother was assaulted and killed by accused persons after coming into conspiracy with each other.
A supplementary affidavit is filed on behalf of the petitioner.
Submission is that prior to institution of the present case, informant's brother, who was injured at that time, himself lodged a case giving written statement in which he has
Patna High Court Cr.Misc. No.46509 of 2018(2) dt.01-08-2018 2/2 specifically made accusation against three persons namely Sunil Yadav, Rajesh Yadav and Randhir Yadav and that three accused indiscriminately assaulted him with stick and rod causing injury to him and later on he succumbed to injury, so there is no allegation against this petitioner regarding committing assault to the deceased, moreover petitioner has also no criminal antecedent.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Rahul Yadav @ Akhilesh Yadav is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 80 of 2018.
