The petitioner is languishing in custody in a case registered for the offences punishable under Sections 307, 427, 506/34 of the Indian Penal Code, Sections 27 of the Arms Act and Sections 3, 4, 5 of the Explosive Substances Act.

The allegation in brief is that 20-25 miscreants including the petitioner fired on the house of the informant. They also exploded a bomb inside the house of the informant in the night while the informant's family were sleeping.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.18879 of 2023(2) dt.12-05-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. No overt act is alleged against the petitioner. The petitioner is languishing in custody since 08.01.2023. Moreover, similarly situated co-accused has been granted bail vide order dated 05.05.2023 passed in Cr. Misc. No. 7213 of 2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S. Case No. 434 of 2017.
