Petitioner is apprehending his arrest in K.Hat (Sahayak) P.S.Case No.74 of 2018 registered for the offences under Sections 341, 323, 406, 420, 504 and 506 of the I.P.C. There was an agreement for sale of the truck with the informant and the petitioner and he had to deposit total amount of Rs.20,60,000/- in installments. But he had paid only two installments and thereafter he is not paying installment. Submission of the learned counsel for the petitioner is that his truck was seized by the D.T.O. and, as such, he is not depositing installment and he is ready to return the truck in good condition. If the petitioner so desires.

No.48207 of 2018 (2) dt.23-08-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with direction to the petitioner to surrender before the learned court below within a period of six weeks from today and the court below will grant him provisional bail for a period of two months and in the meantime issue notice to the informant and after hearing the informant he will pass an appropriate order on the proposal of the petitioner that he is ready to return the truck in question.
