The petitioner seeks bail in Ahiyapur P.S. Case No. 535 of 2017 registered under Section 399 and 402 of the Indian Penal Code Section 25 (1-b)A, 26 and 35 of the Arms Act. As per the prosecution case, the petitioner along with other accused persons are said to have congregated at NH-77 to commit an offence and on chase one live cartridge was recovered from his possession.

It is submitted by learned counsel for the petitioner that the petitioner is a student. He has been falsely implicated in this case. He has no concern with the aforesaid occurrence. No incriminating article has been recovered from his conscious physical possession. The petitioner has been languishing in

Patna High Court Cr.Misc. No.54898 of 2017 (02) dt.15-12-2017 - 2 - custody since 10.07.2017. Similarly situated co-accused Raj Kishore Kumar has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 47241 of 2017 vide order dated 17.10.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No.535 of 2017.
