The petitioner is in custody since 06.05.2018 in connection with Fatuha P.S. Case No. 273 of 2018 for the offence registered under Section 341,323,379,411,504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire case is false and fabricated and is based merely on the basis of the statement of the informant, without verifying any fact, in connection with the present case.

It is further submitted that the petitioner has relevant document of both the Bolero vehicles. The said documents have been filed before this court as annexure-2 series, thus, the entire case is false and fabricated and the petitioner is entitled to be released

Patna High Court Cr.Misc. No.46015 of 2018(2) dt.14-08-2018 2/2 on bail.

Considering the aforesaid facts and circumstances of the case and the fact that the petitioner save and except this case, is accused in one case vide Mohiuddin Nagar P.S. Case No. 42 of 2017 of Bihar Excise (Amendment) Act and in this case he is on bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Patnacity, in connection with Fatuha P.S. Case No. 273 of 2018.
