2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8 and 20(b) (ii)(b) of the N.D.P.S. Act.

3. As per prosecution case, 3 bags containing Ganja weighing 3.150 Kg was recovered from a motorcycle. Name of this petitioner transpired during course of investigation.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner is neither driver nor owner of the motorcycle in question and has got no concern with the alleged recovery.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that huge quantity of Ganja has been recovered. Petitioner is named in the F.I.R. and has also got one criminal antecedent.

6. Considering the nature of accusation, huge quantity of recovery of Ganja and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected (Prabhat Kumar Singh, J) shashank/- U T
