The petitioner seeks bail in Brahampura P.S. Case No. 250/15 instituted for the offences under Sections 384, 436 and 307 of the Indian Penal Code.

The petitioner was earlier granted bail vide Annexure2 to the present application. The present case is misuse of the bail earlier granted to the petitioner.

It has been submitted on behalf of the petitioner the petitioner had gone out of State for his livelihood and during his absence, proper pairvi could not be made on behalf of the petitioner. The bail of the petitioner was cancelled on 08.03.2017. The petitioner had no knowledge regarding the same nor he was informed by his pairvikar. The petitioner had

Patna High Court CR. MISC. No.20661 of 2020(3) dt.30-09-2021 2/2 no intention to avoid disappearance from the Court. Subsequently, the petitioner was taken into judicial custody in respect of the present case on 10.12.2019 and since then he is in custody for approximately 22 months.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -III, Muzaffarpur in connection with S. Tr. No. 236/16 arising out of Brahampura P.S. Case No. 250/15. It is expected that the petitioner shall cooperate during the trial.
