We note that learned writ court has dealt with each and every issue in its right perspective. The appellant participated in the process of no confidence motion without any protest and cast his vote and the motion was decided against the petitioner. Thereafter, fresh election has been held and new body has been constituted.
That being the factual position now we are not inclined to interfere with the impugned order. However, any legal points involved are left to be considered, in case, required in an appropriate case. The appeal is accordingly, dismissed. (Rajendra Menon, CJ) (Anil Kumar Upadhyay, J) Ravi/- U
