The petitioners being the mother-in-law and brother-in-law are apprehending their arrest in a case registered for the offences punishable under Sections 302, 328, 120B of the Indian Penal Code.
Prosecution case is that the son of the informant was married with the daughter of the petitioner no. 1 about four years prior to the occurrence. The son of the informant went to his in-laws house since the infant child was ill, but subsequently he died in the in-laws house. It was suspected that the poison was administered to the son of the informant.
It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.29948 of 2015 (2) dt.29-07-2015 petitioners that the victim was alcoholic and due to over consumption of the alcohol he died. Post-mortem report does not reflect any external injury, cause of death has not been ascertained hence viscera has been preserved. Hence, only on suspicion the accusation has been levelled.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Jankinagar P.S. Case No. 30 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
