Mr.Amitesh Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-10-2020 Heard learned counsel appearing for petitioner as well as learned Additional Public Prosecutor appearing for State through video conferencing.
Petitioner is in jail custody since 14.12.2015 in Patrakar Nagar P.S. Case No.335/2015 registered under Section 364(A), 120(B), 201 of the IPC.
Earlier the prayer of bail of the petitioner was rejected on merit up to the apex court of this country, but submission on behalf of the petitioner is that petitioner is in jail custody for more than four years but up till now the trial has not been concluded.
Perusal of record goes to show that petitioner does have criminal antecedent of near about eleven cases and he appears to be a harden criminal. He has been made accused of
Patna High Court CR. MISC. No.20755 of 2020(3) dt.12-10-2020 2/2 kidnapping, which is a very serious offence and, therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, hence his prayer for bail stands rejected. However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
