The petitioners seek bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 40 pouches (each containing 200 ml.) and 90 pouches (each containing 200 ml.) of country made liquor were recovered from the possession of the petitioner nos.1 and 2 respectively. Petitioners claim that they are having clean antecedent and are in custody since 25.08.2017, i.e., about 3 months.

Having regard to the facts and the circumstances of the case and also the fact that one of the petitioners is lady, the

No.56105 of 2017(2) dt.23-11-2017 2/2 abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge V, Munger in connection with Kotwali P. S. Case No. 289/2017. Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
