The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No.144 of 2015 registered for the offences punishable under Section 395 of the Indian Penal Code. The allegation, as per the Fardbeyan, is that in the night of 13.09.2015, four - five miscreants, covering their face, entered into the house of informant for committing dacoity. They assaulted the informant and her husband. During scuffle, the informant caught hold the hand of one miscreant and pulled his mask and then she identified this petitioner and other co-accused Srawan Kumar.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.56546 of 2017 (2) dt.12-12-2017 anticipatory bail of the petitioner was rejected and thereafter he surrendered before the court below and since 01.09.2017 he is in custody. The other co-accused Srawan Kumar was arrested by the police from his house and has been allowed bail in Criminal Miscellaneous No.50619 of 2015 by one of the coordinate Bench of this Court.
The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Parsa Bazar P.S. Case No.144 of 2015.
