JUSTICE SUDHIR SINGH ORAL ORDER 27-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends arrest in a case registered for the offences punishable under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The informant has alleged that while his brother Manoj Kumar was collecting bricks at his Darwaza, the accused persons including the petitioner came there and on their instigation Renu @ Manju Kumari brought a gun and gave to her husband Abhay Kumar @ Munna who fired which hit the brother of the informant on his chest who succumbed to the injuries. On behalf of the petitioner it is submitted that the petitioner has no criminal antecedent. The petitioner is a lady. No

Patna High Court Cr.Misc. No.29242 of 2015 (2) dt.27-07-2015 specific injury has been attributed against the petitioner. The main allegation is against Abhay Kumar.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the facts aforesaid, let the petitioner above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, be enlarged on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Beldaur P.S. Case no. 88 of 2014, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
