JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in connection with Ariari (Kasar) P.S. Case No. 108 of 2014 for the offences instituted under Sections 420, 272, 273 of the IPC and 47(a) of the Excise Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the police reached the house of one Raj Kumar Mandal. On seeing the police party, accused persons started to flee away but one person was apprehended who disclosed his name as Gopesh Kumar and from whose possession 32 liters liquor was recovered. Gopesh Kumar has also stated that he used to supply liquor to Raj Kumar Mandal on the direction of this petitioner.

Patna High Court Cr.Misc. No.28815 of 2015 (2) dt.23-07-2015 2/2 It has been submitted on behalf of the petitioner that no recovery was made from possession of the petitioner. Whatever the recovery is there that is from possession of co-accused Gopesh Kumar. It is further submitted that the petitioner has got no criminal antecedent.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Ariari (Kasar) P.S. Case No. 108 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sheikhpura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
