ANJANA MISHRA ORAL ORDER 15-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.06.2017 in connection with Shahkund P.S. Case No.108 of 2017 registered for the offence under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., but subsequently on the confessional statement made by co-accused, the petitioner was taken into custody. It is submitted that the entire allegations as made out are improbable and motivated and it is not the bus Driver who has lodged the F.I.R. but merely one of the passengers who has filed the present case. Patna High Court Cr.Misc. No.59149 of 2017 (2) dt.15-12-2017 2/2 persons have since been released on bail by the court below itself, vide Bail Application No.1090 of 2017 and Bail Application No.1132 of 2017.
Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhagalpur, in connection with Shahkund P.S.
