In this case, the petitioner is claiming that he is entitled to an undisputed amount of Rs. 13,16,580/- whereas he has been paid a meager amount of Rs. 2,58,000/-.
An advertisement was published on 09.03.2007 for conducting the special school for Child Labour under Saran District. The petitioner has also filed an application for the same and fortunately he was picked up and, accordingly, the petitioner entered into an agreement on 28.09.2007, whereafter, the petitioner was
Patna High Court CWJC No.20325 of 2016 dt.01-05-2017 running the two Child Labour special schools namely Child Labour Special School, Rasulpur and Child Labour Special School, Katsah. The inspection was conducted from time to time. The petitioner has submitted that he has run the school from 2007 to 2010 and is entitled for Rs. 15,74,578/- whereas he has been paid only Rs. 2,58,000/-. Let the matter be referred to the Commissioner of the Saran Division who will examine and conduct enquiry into the matter about the existence of the Child Labour Special School, Rasulpur and Child Labour Special School, Katsah and its running for the period 2007 to 2010. If it is found true that the petitioner has run the schools, the Commissioner, Saran Division will pass an appropriate order for payment of the said amount to the petitioner. Let the Commissioner, Saran Division, should examine the matter and take a decision within a period of five months from the date of receipt/production of a copy of this order. With the aforementioned observation and direction, this application is disposed of.
