JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-05-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Kateya P.S. Case No. 411 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The accusation is that in course of patrolling duty, two motorcycles were seen. On giving signal to stop the motorcycle, both riders of the motorcycles started fleeing leaving the motorcycles. On search of blue colour Bajaj motorcycle, 94 bottles, each containing 180 ML Indian made foreign liquor kept in sack and on search of blue colour T.V.S. Apachy motorcycle, 499 pieces, each containing 200 ML country made liquor recovered.

Learned counsel for the petitioner submits that it

No. 15793 of 2020(2) dt.15-05-2020 2/2 has come in course of investigation that petitioner is the owner of blue colour bajaj motorcycle from which 94 bottles, each containing 180 ML Indian made foreign liquor is said to be recovered. Further submission is that while petitioner is accused in Gopalpur P.S. Case No. 142 of 2018, but in that case, the name of the petitioner surfaced in the confessional statement of co-accused. In the present case, the petitioner is in custody since 09.02.2020.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-II-cum-Special Judge (Excise), Gopalganj in connection with Kateya P.S. Case No. 411 of 2019.
