JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-08-2023 The present writ petition has been filed seeking the following reliefs:- "1. That the present writ petition is being filed on behalf of the petitioner above named who was posted as a Chaukidar in Barsoi Police Station and after due service has been asked to retire on 30.04.2012 which is approximately 12 years earlier than the date upon which he should have superannuated as the date of birth demonstrated in the school leaving certificate of the petitioner is 01.01.1964 whereas the date of birth of the petitioner has been
Patna High Court CWJC No.9809 of 2015(2) dt.17-08-2023 2/3 shown to be 09.04.1952 in the service book. In the aforesaid facts and circumstances the petitioner prays for the following reliefs:
I. The date of birth of the petitioner as demonstrated from the school leaving certificate i.e. 01.01.1964 be modified in his service book.
II. The petitioner after due modification in the service book be reinstated in service and his services be regularised.
III. The respondent authorities be directed after the regularisation to pay the arrear of salary etc. from the date of regularisation."
At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty, so
