The petitioner, who is in custody, seeks bail in connection with Bounsi P.S. Case No. 235 of 2016 registered for the offence punishable under Sections 366(A), 504/34 of the Indian Penal Code.

Informant is the husband of victim girl, his written complaint addressed to Officer-in-Charge Bounsi Police Station in which it has been stated that on 21.12.2016 at about 4.00 pm when he had gone for cultivation, one boy came with motorcycle and started talking with his wife and thereafter he took away his wife and after much search she could not be traced and thereafter present complaint case has been filed. The girl has been recovered by the police and in her

Patna High Court Cr.Misc. No.60014 of 2017 (3) dt.16-01-2018 2/2 statement under Section 164 Cr.P.C. she has stated that she went with the accused petitioner at various places and thereafter she returned home. The girl was medically examined by the Medical Board and has assessed the age of the girl above 18 years. It has been further stated in the medical report that no sign of rape or any injury on private part or any part of body was found. It has been further submitted that petitioner has no criminal antecedent and he is in custody since 04.09.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Banka, in connection with Bounsi P.S. Case No. 235 of 2016. (S. Kumar, J) veena/- U T
