JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 Petitioner seeks regular bail in connection with Majhauliya P.S. Case No.359 of 2016 registered for the offences punishable under Sections 363, 366(A) and 302 of the Indian Penal Code.

As per F.I.R. the daughter of the informant was traceless but the informant has expressed his suspicion on the bearer of mobile no.7491934278 and 8287597741, from which calls were received from that of his mobile no.7079145287. Petitioner is not named in the F.I.R. but later on, his name transpires on the basis of suspicion.

Submission of the learned counsel for the petitioner is that petitioner has falsely been implicated in this case on the basis of suspicion and another co-accused is similar to that of the petitioner has been granted bail by a Co-ordinate Bench of

Patna High Court CR. MISC. No.17639 of 2019(3) dt.21-05-2019 2/2 this Court vide order dated 30.07.2018 passed in Criminal Misc. No.28611 of 2018. Further submission is that petitioner is in custody since 10.01.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, West Champaran, Bettiah, in connection with Majhauliya P.S. Case No.359 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
